After the Kean Commission cut a deal Wednesday to restrict its own access to the White House documents, 9/11 Commissioner and former Sen. Max Cleland went on CNN with Wolf Blitzer to say:

Under the deal only 2 or 4 of the Commissioners will be able to view White House documents about what Bush knew of the coming attacks on 9-11 after the White House edits them. They can only take notes, and they must get White House approval before telling other commissioners what the notes say.

Relatives of Sept. 11 victims criticize agreement between White House and commission

Relatives of people who perished in the Sept. 11 attacks say a federal commission accepted too many conditions in striking a deal with the White House over access to secret intelligence documents.

The Family Steering Committee, a group of victims' relatives who are monitoring the work of the independent commission, criticized the agreement announced late Wednesday. Under the deal, only some of the 10 commissioners will be allowed to examine classified intelligence documents, and their notes will be subject to White House review.

"All 10 commissioners should have full, unfettered and unrestricted access to all evidence," the group said in a statement Thursday. It urged the public release of "the full, official, and final written agreement."

Neither the commission nor the White House disclosed the terms of the agreement, although sources familiar with the commission's work described some of its provisions.

WASHINGTON—In capital shorthand, they are known as PDBs, and they may hold the key to one of the great unanswered questions of the Sept. 11, 2001, terrorist attacks.

Did U.S. President George W. Bush receive — and ignore — advance warning of a plan by Al Qaeda to hijack passenger planes and fly them into buildings in the United States?

A commission studying the causes of America's worst terrorist attack is closer to finding that answer today, but families of the victims and at least one member of the 10-person tribunal say they aren't close enough.

Tim Roemer, a panel member who was also denied White House documentation when he sat on a congressional committee studying 9/11, says more hurdles put up this week by Bush may mean the world will never really know what the president knew.

The White House and the bipartisan commission, headed by former New Jersey governor Thomas Kean, a Republican personally chosen by Bush, have struck a compromise on the commission's demand that they have access to the Presidential Daily Briefs (PDBs), the highly classified intelligence documents made available to only Bush and his innermost circle.

The National Commission on Terrorist Attacks Upon the United States has reached an agreement with the White House that will allow commissioners unprecedented access to materials from the president's daily intelligence briefs, the most sensitive documents the government produces.

For the first time ever, the president will allow individuals other than the most senior officials in the executive branch to see these documents. Access to the briefs will enable the commission to put speculation to rest.

The commission will be able to state authoritatively what information and threat warnings were provided to presidents Clinton and Bush. Access to these daily intelligence briefs will enable the commission to fulfill its mandate to prepare an authoritative report on the events of Sept. 11, 2001, for the American people.

Two representatives from the commission will check the items responsive to our document request. Four representatives from the commission will constitute our review team to examine all items of critical interest in the Sept. 11 probe. Our review team will provide a complete report on the critical documents to all commissioners. The commission, in turn, will be able to use this highly classified information to inform the writing of its public report. So an assertion that all commissioners will not read every single document, while true, is misleading.

Even more misleading is an assertion that the White House is editing the material being made available to the commission. The commission requested a broad range of relevant intelligence. Hundreds of responsive articles have been produced. None of these relevant articles is being edited in any way. The commission will have access to everything -- we repeat, everything -- it asked to see.

The law that created the commission mandated an investigation of the facts and circumstances surrounding the terrorist attacks on the United States and the immediate response to those attacks. The commission therefore never asked to see other intelligence presented to the president on subjects that have nothing to do with the Sept. 11 attacks -- for example, items dealing with China, Kosovo, Colombia or hundreds of other topics.

The agreement before us gives the commission access to materials on which the executive's claim of executive privilege and state secrets is strong. If the commission had subpoenaed these documents, the White House would no doubt have fought the subpoena to avoid setting a damaging constitutional precedent.

In that case, the commission might have seen no documents and could have been tied up in the courts past its date of expiration. The choice before us is not unrestricted access versus conditional access; the choice is between access to fulfill our mandate and no access at all. Under this agreement, the commission has gained a degree of access to sensitive information unequaled in the history of the United States.

The agreement before us gives us the ability to fulfill our mandate, and it respects the integrity and independence of the commission. Some charge that this agreement "compromises" the commission's work. We obviously disagree...

Proof of prior knowledge of the September 11 attacks is continuing to trickle out of the purportedly “leak-proof” White House, as more corroborative chickens of 9/11 are coming home to roost -- even as President Bush is considering invoking executive privilege to keep the clamps on evidence that could alter the political landscape for the nation’s conquering “top-gun.”

However, for those still concerned about the mysteries of September 11, such issues as: 1) poorly documented visas -- issued fraudulently by immigration officials failing to follow the law, 2) restrained U.S. military air defense protocols, 3) millions of dollars in suspicious pre-attack stock market insider trading profits as yet unclaimed and unrevealed within a still-unpublicized Securities Exchange Commission 9/11 “Control List,” 4) redacted presidential intelligence documents, plus other unanswered questions directly related to prior knowledge of the attacks all seem fair game -- given the explosive evidence.

Newly-revealed statements from a CIA July, 2001 presidential intelligence briefing -- when placed within the context of planes crashing into buildings, one-by-one on September 11 -- should bring to mind Bush’s reactions that morning at the Sarasota, Florida elementary school. But the public has never heard the reason for the President’s lack of swift and decisive action at the school.

...Cleland is crying foul; so is former Rep. Tim Roemer, also a Democrat. And the Family Steering Committee - which has already made clear that it won't be satisfied unless somone other than Osama bin Laden is blamed for the 9/11 attacks - is demanding to see "the full, official and final written agreement."

President Bush was right to approach this matter cautiously for fear of the precedents that are being set here.

He's also right to warn that "the writers of the Presidential Daily Brief [must] feel comfortable that the documents will never be politicized and/or unnecessarily exposed for public purview."

Yes, 9/11 was unusual - and the need for a thorough reckoning of the failures that permitted it is vital. But, again, that's why the deal, which the Bush folks say they can live with, is fortunate.

Unfortunately, the critics will never be happy, and some commission members are only interested in a politicizing the process, anyway.

That has pitted the search for an honest evaluation of the pre-9/11 intelligence and policy failures against the search to skewer the president.

On a matter as important as this, Americans have a right to expect better.

SOLEDAD O'BRIEN, CNN ANCHOR: Now to the work of the independent commission studying the events surrounding 9/11. In an unprecedented move, the White House last week said it would give the commission access to some of its most sensitive, secret documents. But some of those who lost loved ones on 9/11 say that is not nearly enough. Among them is Christian Breitweiser. Her husband, Ron Breitweiser, was killed in the attack on the World Trade Center. And Kristen is a member of the Family Steering Committee for the 9/11 Independent Commission. She joins us this morning.

It's nice to see you as always, Kristen. Thanks for coming in.

The commission struck this deal with the White House, including among the things that they got was access to the PDB, which is the president's daily briefing. Experts say that this is huge. This is, some will say, the most intimate kind of communication that the president can have with his briefing staff. It is unheard of. And you say, still not good enough, doesn't go far enough. Why?

KRISTEN BREITWEISER, HUSBAND KILLED ON 9/11: You know, I think undoubtedly the president's daily briefing has not been released. But this is not a congressional body. This is a quasi-legislative executive branch entity. And I think never before in history were over 3,000 Americans murdered on the homeland. I think that this situation calls for the release of this information. This commission needs full, unfettered access. All 10 commissioners need to see the PDB. And the reason for that is because we had a national security adviser come out days after the attacks and say we had no idea they could use planes as missiles.

We have a historical record that is replete with incidences of al Qaeda and terrorists possibly using planes as missiles. We need to find out how our national security adviser didn't know that. We need to find out exactly where that intelligence information, the flow of that information, had a breakdown so that it didn't reach the national security adviser.

O'BRIEN: Is it the White House not going forward with giving the information, or do you say the commission, the 9/11 commission itself, is not pushing hard enough to get access to this information?

BREITWEISER: Frankly, I think that it's a tenuous situation. But I think none of this had to be a debate. None of this had to be negotiated, if the White House on day one handed over these documents.

This commission's mandate is to take off where the joint inquiry left off. The joint inquiry stated in its recommendations that an issue arose. What had happened was, they were investigating the intelligence failures. They found out in testimony from a witness, something that contradicted what Condoleezza Rice said. They tried to look into that and they were blocked. The joint inquiry thereafter said something needs to be done about this, this issue needs to be reconciled. This commission's mandate is to take off where they left off. It is totally within their mandate to find out why one person said something, and Condoleezza Rice said something else. We need to reconcile that.

O'BRIEN: The White House might say regardless of what the mandate is, we have to be careful of the national security of our nation, and therefore we can't go ahead and give you access to all this, only to protect the country.

BREITWEISER: Undoubtedly. But you know what, it is our position that this is about national security. We need to find out why that information did not get into Condoleezza Rice's hands. The only way you do that is accessing the final document, the PDB, and backtracking, and finding out where along the way it got dropped out. We need to find out why it was, you know, toned down, or dropped down, and didn't make it into her hands. This is about the safety of the nation. That's what national security is. We all want the same goal, we all need to work toward that goal.

O'BRIEN: The commission could have sued, could have subpoenaed the records, but it would have been, most people will say, tied up in court for years. Do you have any feelings that, well at least we got something now?

BREITWEISER: Look, I don't have any feeling, because unfortunately, ironically enough, this is a historical agreement about access, and yet the American public cannot access the agreement. I mean, it's very ironic. So it's our position that they should release this agreement. Let it become part of the public debate, let the public see the deal that has been struck.

And my understanding of it is that it has many restrictions. There are many hurdles that need to be jumped over. This is not access. This is access with a footnote, which, to me, is upsetting. We wanted a definitive report, and now we have a report with a footnote.

O'BRIEN: And you'll never really know because there's no exact sense of what was agreed to in the first place.

1) Limited access to PDBs -- a compromise to be sure:

This recent compromise is just that: it clearly doesn't give the Commission full and unfettered access to the full body of the Presidential Daily Briefs. It's gives access to redacted versions to only two commissioners who then must present thier notes to White House counsel for review.

It violates the statute mandating that 10 commissioners fully investigate 9/11 with the goal to create the definitive account of what happened on 9/11. Such conditions on access and filtering by the White House and a minority of commissioners compromises the integrity of the investigative process.

Express your doubts about this serious breach of investigative standands and violation of their mandate.

In addition, why does the Commission refuse to turn over the 'fine print' in the agreement?

Surely there is no risk to national security in doing so!

2) Missing National Security Counsel (NSC) documents?:

What ever happened to discussion regarding the Commission access to National Security Counsel minutes/briefings/etc.?

Will the Commission also seek access to these important documents?

Will they see the minutes and directives that emerged out of the Counterterrorism Security Group meeting that Counterterrorism chief Richard Clarke called for and held on July 5th, 2001?

These documents and the PDBs could as Kristen Brietweiser pointed out this morning (Monday) on CNN (transcript to follow) shed light on whether or not there was discussion in the White House about the danger of attack from terrorists using planes as weapons. Obviously, if there was such a warning the failure of FAA and NORAD on the morning of the attacks is all the more stunning and deserving full redress and accountability.

According to Kristen, a source revealed to the Congressional Joint Inquiry that indeed there was awareness within the intelligence community about just such a threat . This general pre-9/11 awareness was confirmed by Senator Shelby when asked about it by 9/11 CitizensWatch co-founder John Judge during the C-SPAN taped press conference for the Joint Inquiry Report. Sen. Shelby also confirmed that their investigation had found that no action had been taken to prepare for such a defined method of attack.

3) Executive Director Dr. Zelikow's major conflict of interest:

Ask for a formal statement why the Commission has elected to dismiss family member concerns that there exists a major conflict of interest with Executive Director Dr. Phillip Zelikow.

Zelikow was involved in the transition team for the Bush National Security Council (NSC) and has co-authored a book with Bush National Security Advisor, Condaleeza Rice.

4) Testimony under Oath?:

Why aren't witnesses being asked to testify under oath?

In four previous public hearings about major issues of national security and about getting the timeline accurate relative to the events of the morning of 9/11 not a single witness has taken the Oath.

Now, according to Commissioner Roemer who appeared on C-SPAN's Washington Journal this morning (Monday, Sept. 17th) the Commission IS asking that those who testify in closed door meetings do so under oath.

Last we heard from Chairman Kean on this issue we learned that the Commissioners had debated it and decided they felt witnesses would be more forthcoming if there wasn't a lawyer sitting alongside them during their testimony. On its face this is counter-intuitive and breaks with investigative standards typically applied to important hearings; unless of course there is no intention whatsoever by the commission to hold people accountable to their word.

Here are some of the questions I have for the Commission:

When did the commission decide to have "behind closed doors" witnesses testify under oath?

Why didn't the Commission inform the public of this change in investigative practice?

What is the rationale for requiring an oath for all non-public interviews and not for those testifying before the American public?

PLEASE EXPLAIN

5) Administration or Govermment Minders at all interviews:

Is the Commission still allowing 'minders' to sit in on all the interviews it conducts as it seeks to fulfill it mandate?

If they object in principle as they said they do, then why do they continue to allow it?

6) Interim Reports -- Findings of Fact:

A year has passed since the Commission was signed into law.

Why in the interest of national security and informing the American people has the Commission not issued a single finding of fact or any substantive interim reports?

Chairman Kean has said that some of "the theories out there are wrong". Clearly he must have based this conclusion on evidence he had confirmed.

Why not issue a report that clearly discounts wrong-headed and distracting theories about 9/11?

Furthermore, victim family members and independent investigators have done extensive research on the events of 9/11.

Why not exercise more transparency in the public interest?

Surely, the work of a staff of 60 can withstand the scrutiny of other concerned americans investigating 9/11 on their own and desirous of holding the Commission to the highest possible standards.

7) Ask the Commission if the staff have copies of Paul Thompson's Complete 9/11 Timeline and the work of Nafeez Ahmed in The War on Freedom. Encourage them to do so.

8) Ask them to hold public hearings in New York City before they conclude their investigation.

The victims' family members and New Yorkers should get another opportunity to be witness to the work of the commission in its public hearings.
