White House Faces Crunch Time on 911 Files

Two weeks and counting.
After that, the independent commission investigating the terrorist attack of Sept. 11, 2001, says it is going to blow the whistle. Again.
"We spend a long time on negotiating on access," said former Rep. Lee Hamilton of Indiana, the 9/11 commission co-chairman. "And we have laid down a marker here in which we indicate that we need this information in two weeks' time. So we are approaching a crunch point, I believe."
You may wonder why, two years after the attacks that slaughtered more than 3,000 people and set the United States on a course of indefinite war, it has come down to these two weeks. The families of Sept. 11 surely do. It is nine months, after all, since the commission - the only one empowered to fully probe the events of that day - was established. There are only eight more left until, by law, it expires.
The answer is that the White House has never wanted this commission. It fought against it for a year. Once it became politically impossible to stop, the administration engaged in a rear-guard action to slow its work, a stall meant to last until May, when the panel goes out of existence. Documents and witnesses were coming forth with such determined sluggishness that Hamilton, a Democrat, and his Republican counterpart, former New Jersey Gov. Thomas Kean, voiced concern about being thwarted. Since their extraordinary public complaint in July, much has gone better. Surprise.
"We had, shortly after that, a genuine flood of documents," Kean said at the panel's briefing on Tuesday.
Even from the White House. And except from the White House.
"Pending requests seek additional sensitive documents," the commission's latest report to the people says. "Extensive negotiations" continue and the commission has received "certain assurances" - but not all it needs - from the White House.
"We will inform the public very promptly if the commission does not receive the access that we need to do our job," Kean said.
The joint congressional committee that probed intelligence failures before the 9/11 attacks wrote, in its final report, a 15-page appendix about this very trouble. "Access Limitations Encountered by the Joint Inquiry," the chapter is called.
Information withheld from Congress included the president's daily brief, especially a crucial one produced in August 2001 that warned of possible terrorist attacks, including hijackings. Information relating to the development of a Bush counter-terrorism policy before 9/11 also was kept from the lawmakers.

White House Not to Declassify More of 9/11 Report

WASHINGTON (Reuters) - The White House has said it will not declassify further parts of a congressional report on intelligence failures related to the Sept. 11 attacks, including details of possible foreign involvement in the plot.
President Bush's national security adviser, Condoleezza Rice, said in a letter to a U.S. senator received on Tuesday that declassifying more of the report now could jeopardize current investigations.
The letter to Sen. Bob Graham, a Florida Democrat, responded to his request that classified portions of the report be made public.
The report released publicly in July included a blank 28-page section that dealt with whether there was any Saudi or other foreign government ties to the Sept. 11 plot. Saudi officials have also asked that the section be declassified.
The classified parts of the report contained information "relating to sources and methods, to ongoing investigations tied to the September 11, 2001 attacks, and to law enforcement and intelligence collection targets," Rice said in the letter dated Sept. 26, but received by Graham on Tuesday.
Graham, who is seeking the Democratic Party's nomination for U.S. president, chaired the Senate Intelligence Committee last year during its joint Sept. 11 inquiry with the House Intelligence Committee that produced the report detailing intelligence failures.
... "This is a disservice to the American people," Paul Anderson, spokesman for Graham, said. "Senator Graham feels strongly that they deserve to know about the potential involvement of foreign governments to the plot that led to the tragedy of September 11."

CIVIL LIBERTIES in an age of terrorism require a careful balance between preserving important rights cherished by all Americans and the need for law enforcement to investigate and prevent terrorist attacks. The importance of a balanced standard is particularly evident in President Bush's request to Congress for additional law-enforcement powers to investigate terrorist suspects while questions persist about why the White House and FBI permitted 140 Saudis (including two-dozen relatives of Osama bin Laden) to leave hurriedly from the United States for Saudi Arabia.
In the days immediately following Sept. 11, 2001, while the airways were still closed to all other flights, Americans couldn't fly into the country but relatives of bin Laden were able to fly out. The Justice Department and the FBI inspector general should investigate why these obvious "persons of interest" were permitted to leave the country without being seriously interrogated.
Why should the American people trust the Bush administration with greater police powers when it refuses to answer questions about the bin Laden family's escape? As Senator Charles Schumer of New York has said, it was too soon after 9/11 for the FBI even to know what questions to ask, much less to decide conclusively that each Saudi and bin Laden relative deserved an "all clear," never to be available for questions again.
The American people deserve answers to these questions:
